Terms of Service

These terms govern your use of the Image Analyzer service ("Service") operated by BUSINESS_NAME ("we", "us"). By creating an account or using the Service, you agree to these terms.

1. What the Service does — and doesn't claim

The Service measures geometric and structural consistency across sets of photos. It surfaces ranked anomalies — places where photos in a set disagree with one another — and presents these as ranked signals for your review.

Results are signals to inform a human's review, not conclusions. You agree not to rely on the Service as the sole basis for any consequential decision.

2. Eligibility

You must be at least 16 years old to use the Service. By creating an account you represent that you are at least 16 and legally able to enter into this agreement.

3. Account responsibilities

• You're responsible for keeping your password secure.
• You're responsible for activity under your account.
• One person per account. No shared or sold accounts.
• Provide a real email address. We use it for service-critical communications only.

4. Acceptable use

You agree not to:

• Submit images of child sexual abuse material (CSAM), or any other illegal content. Such uploads may be reported to law enforcement.
• Submit images you do not have the legal right to use.
• Use the Service to harass, dox, stalk, or surveil any person.
• Attempt to bypass content-moderation, rate limits, or pricing logic.
• Reverse-engineer, scrape, or programmatically abuse the Service.
• Resell access or wrap the Service inside another commercial product without written permission.

We reserve the right to suspend or terminate accounts that violate these rules, with or without notice depending on severity. Where required, we will refund unspent credits on terminated accounts unless termination was for illegal use.

5. Credits and pricing

The Service operates on a credit system. You purchase credit packs in advance, and credits are deducted per analysis run. Free triage runs entirely in your browser and does not consume credits.

• Failed jobs are refunded. If a paid analysis fails for a technical reason on our side, the cost is automatically refunded to your credit balance.
• Limited results are half-charged. If an analysis completes but produces low-quality results (subject couldn't be reliably identified, or no comparable measurements were found), half the cost is refunded automatically.
• Successful analyses are non-refundable. Credits used on a completed, useful analysis are not refundable, except where required by law (e.g. statutory cooling-off periods for first-time purchases in some jurisdictions).
• Credits do not expire while your account is active.
• Pricing may change. Existing credit balances retain their original purchasing power for at least 90 days from any price change.

6. Caching of results

To save you money, results are cached against a one-way fingerprint of your image set. If you re-submit the same images, you get the stored result instantly without being charged. The fingerprint cannot be reversed back into images. See our Privacy Policy for details.

7. Intellectual property

• You retain all rights to images you submit. We do not store them and claim no rights over them.
• The analysis results we produce from your images are made available to you under a non-exclusive licence to use however you like, including commercially.
• The Service itself, including the website, code, model integrations, and documentation, is owned by us. You may not copy, redistribute, or create derivative services without permission.

8. Service availability

We aim for high availability but do not guarantee uninterrupted service. The Service may be unavailable due to maintenance, infrastructure issues, upstream provider problems (RunPod GPU availability, etc.), or other reasons outside our control. Failed jobs during outages are refunded automatically.

9. Disclaimer of warranties

The Service is provided "as is" and "as available" without warranties of any kind, express or implied. We disclaim all warranties to the maximum extent permitted by law, including warranties of merchantability, fitness for a particular purpose, and non-infringement. The Service's outputs are analytical signals, not professional advice.

10. Limitation of liability

To the maximum extent permitted by law, our total liability to you for any claim arising from your use of the Service is limited to the amount you paid to us in the 12 months preceding the claim. We are not liable for indirect, incidental, consequential, or punitive damages.

Nothing in these terms limits any rights you have under the Australian Consumer Law or similar non-excludable consumer protection legislation in your jurisdiction.

11. Indemnity

You agree to indemnify us against claims arising from your misuse of the Service, your submission of unlawful or infringing content, or your breach of these terms.

12. Termination

You can close your account at any time using the "Delete Account" button on your account page. We may terminate your account for material breach of these terms, with notice where reasonable.

13. Governing law

These terms are governed by the laws of Australia. Any dispute will be resolved in the courts of BUSINESS_STATE, Australia, except where mandatory consumer-protection rules in your jurisdiction require otherwise.

14. Changes to these terms

We may update these terms from time to time. Material changes will be notified by email and take effect 30 days after notification. Continued use after the effective date constitutes acceptance.
